    A spotted owl site was identified within 1/2 mile of the proposed operation. ODF has determined that the operation as notified is not likely to pose a conflict for the owl site, thus there are no requirements under the Forest Practices Act rules for spotted owls (OAR 629-600-0100(1)). Please be aware that compliance with the Forest Practices Act is not in lieu of compliance with any federal requirements related to the federal Endangered Species Act. Federal law prohibits a person from taking northern spotted owls. Taking under the federal law may include significant alteration of owl habitat on any class of ownership (OAR 629-665-0210 (4)). Landowners and operators are encouraged to communicate directly with the USFWS regarding requirements under the federal Endangered Species Act.
