Legal Notice
WRITTEN PLANS
A Written Plan (in addition to this NOAP) is required before operation activities can begin near the protected resources listed with the Unit information or Site Conditions below or otherwise described to you by the ODF Forester (OAR 629-605-0170(2), (3), and (5)). The Written Plan must describe in detail how the resource(s) will be protected during the operation. There is a waiting period for Written Plans that is separate from the notification waiting period. Contact your ODF Forester for more information.
NEIGHBORLY COMMUNICATION
Notifier must mark each unit as pending by 7 p.m. the day before spraying. For pending units, notifier must report the spray as complete or incomplete. Notifier must mark units as complete within 24 hours of spraying. For partially sprayed units with plans to return to finish spraying, notifier must report the unit as incomplete by 11:59 p.m. the day after spraying.
For units that do not get sprayed, no reporting is needed. The notifier must mark the unit as pending again before spraying.

Please be aware that compliance with the Forest Practices Act is not in lieu of compliance with any federal requirements related to the federal Endangered Species Act. Federal law prohibits a person from taking northern spotted owls. Taking under the federal law may include significant alteration of owl habitat on any class of ownership (OAR 629-665-0210 (4)). Landowners and operators are encouraged to communicate directly with the USFWS regarding requirements under the federal Endangered Species Act.

The following comment pertains to units located within Stewardship Forester area 7302; Cody Lokan: FPA protected resources office review complete. There are several small type N streams within the notified area. Per Oregon Senate Bill 1602, all helicopter pesticide spray buffers must be a minimum 50 feet for any type N streams with surface water present, flowing or ponded, at the time of the application. Per notifier- No operation will occur within 100 feet of protected streams. No other concerns or conflicts detected at this time.

The following comments made pertain to units located within Stewardship Forester area 7303; Kyle Temple: FPA protected resources office review complete. FPA protected resources office review complete. There are several small type N streams within the notified area for the Hult and Kelsay unit as well as the Callahan 1 #6 and 11 units. Per Oregon Senate Bill 1602, all helicopter pesticide spray buffers must be a minimum 50 feet for any type N streams with surface water present, flowing or ponded, at the time of the application. Per notifier- No operation will occur within 100 feet of protected streams. No other concerns or conflicts detected at this time.
