    The operation appears to be within 100’ of a tributary to Rock Creek (Small Type SSBT) and Rock Creek (Medium Type SSBT) which are required to be protected. Written plans are required to address protection measures needed for any operation which takes place within 100’ of a Type F, Type SSBT, or Type D stream per OAR 629-605-0170(2). Office resource review complete. No concerns noted at this time other than previously noted.

    A spotted owl site was identified within the proposed operation, however this owl site has been determined to be an “resident single” resource site. Thus it is not a protected resource site under the Forest Practices Act (OAR 629-600-0100(1)) and there are no Forest Practices Act restrictions. Please be aware that compliance with the Forest Practices Act is not in lieu of compliance with any federal requirements related to the federal Endangered Species Act. Federal law prohibits a person from taking northern spotted owls. Taking under the federal law may include significant alteration of owl habitat on any class of ownership (OAR 629-665-0210 (4)). Landowners and operators are encouraged to communicate directly with the USFWS regarding requirements under the federal Endangered Species Act.
