Stream Stream Name: Twincheria Creek, Unnamed Tributary of Twincheria Creek, Unnamed Tributary of Twincheria Creek Stream Classification: Large Fish, Small Fish, Small Fish Statutory Written Plan required by: ORS 527.670(3)(a), OAR 629-605-0170(2) for an operation within 100 feet of a Type F, Type SSBT or Type D stream. After reviewing your written plan, I offer you the following comments. Fully implementing this written plan is likely to achieve the resource protection standards. The written plan failed to address landings or skid trails within the RMAs of type F streams, therefore, no skid trails or landings within the RMAs of type F streams. This operation will be evaluated on the basis of how well required practices are applied and how well required resource protection is achieved. Resource Review - 1) Twincheria Creek LF for approximately 220 feet from NW corner of northern unit east to confluence with unnamed tributary of Twincheria Creek. Unnamed tributary of Twincheria Creek SF for approx 1,230 feet of reach along northern boundary of northern unit. Unnamed tributary of Twincheria Creek in section 12 SF. No operations within 100 feet of LF and 50 feet of SF until a reviewed written plan is on file or January 19th. 2) A spotted owl site was identified within 1/2 mile of the proposed operation, however this owl site has been determined to be an “resident single” resource site. Thus it is not a protected resource site under the Forest Practices Act (OAR 629-600-0100(1)) and there are no Forest Practices Act restrictions. Please be aware that compliance with the Forest Practices Act is not in lieu of compliance with any federal requirements related to the federal Endangered Species Act. Federal law prohibits a person from taking northern spotted owls. Taking under the federal law may include significant alteration of owl habitat on any class of ownership (OAR 629-665-0210 (4)). Landowners and operators are encouraged to communicate directly with the USFWS regarding requirements under the federal Endangered Species Act. 3) No other protected resource concerns at this time 4) Comply with all state and federal rules and regulations and follow herbicide label instructions 11) Must meet all ODF fire prevention and ensure compliance with the rules of Oregon's "Smoke Management Plan" 13) Obtain a burn permit from ODF Medford office prior to burning
