Statutory Written Plan required by: ORS 527.670(3)(a) and OAR 629-605-0170(2) for an operation within 100 feet of a Type F, Type SSBT, or Type D stream. Regarding your Plan for an Alternate Practice modifying: ORS 527.740 involving clearcuts exceeding 120 acres in size within a single ownership. Your plan dated 5/6/21 for your salvage harvest identified in this notification is approved. Recommendations and/or Comments: ORS 527.740(4) allows clearcuts in excess of 120 acres when the clearcut results from natural disasters outside the operator’s control, such as the February 2019 snow and ice storm event, and when the disaster has substantially impaired productivity or safety on the unit or jeopardizes nearby forestland. All those conditions are met in the case of the salvage harvest identified in this notification.

Three spotted owl sites were identified within 1/4 mile of the proposed operation. ODF has determined that the operation as notified is not likely to pose a conflict for the owl sites, thus there are no requirements under the Forest Practices Act rules for spotted owls (OAR 629-600-0100(1)). Please be aware that compliance with the Forest Practices Act is not in lieu of compliance with any federal requirements related to the federal Endangered Species Act. Federal law prohibits a person from taking northern spotted owls. Taking under the federal law may include significant alteration of owl habitat on any class of ownership (OAR 629-665-0210 (4)). Landowners and operators are encouraged to communicate directly with the USFWS regarding requirements under the federal Endangered Species Act.
