Unit 3: The majority of the harvested area has not been planted as required by the Oregon Forest Practices Act, OAR 629-610-0000. This operation is in violation of OAR 629-610-0040 and therefore enforcement will be initiated.

Unit 3: Logging and site prep completed. A pond has been constructed since the logging was completed. The logging operator was not involved in any way with the construction of the pond. The pond (~25’X25’) was constructed by a family member, who in addition to the pond construction, dug the above stream channel out to facilitate focused water flow into the pond. The outlet of the pond flows onto a low gradient, with brush, grasses etc., that appear to filter the sediment. I observed no sediment entering the fish stream at the time of my inspection. The process for pond construction begins with a permit from the Oregon Water Resources Dept. which was not done, and for a large pond would require a removal-fill permit from the Oregon Dept. of State Lands. I met on site with the resident, and we discussed the pond, and once again I reminded him of the Oregon Forest Practices Act reforestation, within 2 years, requirement.

A decision has been made after consulting with ODF Salem, regarding the stream associated wetland observed by myself and the operator at yesterday's inspection. Because hydrology is the main concern, the protection of the stream associated wetland will be to keep equipment off of it. If for some reason a portion needs to be crossed, logs will need to be corduroyed to prevent any damage (i.e. ruts, compaction). No additional uniform buffer width is necessary.

I was informed during my inspection on 3/23 that the landowner of Unit 3 will be completing the reforestation. With the amount of salmonberry present, a herbicide treatment prior to planting is recommended. In addition, a seedling shortage will most likely be a problem in 2022 and 2023 due to fires, and increased logging activity due to unusually high log prices. My recommendation is to order the trees needed as soon as possible, and keep in mind there may be a delay in completing the reforestation, which makes the application of herbicides after harvest even more critical.
