ODF recommends that the USFWS be consulted prior to initiating operational activities regarding timing restrictions to protect the occupied marbled murrelet site from disturbance. Please be aware that compliance with the Forest Practices Act is not in lieu of compliance with any federal requirements related to the federal Endangered Species Act. Federal law prohibits a person from taking marbled murrelets. Landowners and operators are encouraged to communicate directly with the USFWS regarding requirements under the federal Endangered Species Act. A Statutory Written Plan is required for any activity that is within 100 feet of a Type F stream. Operator has requested an waiver of the 15 day waiting period. Waiver of 15 days is granted, since there are no protected resources.
