    After reviewing your written plan for operating near the Hare Creek NSO site #2298O, I offer you the following comments: Fully implementing your written plan is likely to achieve the resource protection standards. This operation will be evaluated on the basis of how well required practices are applied and how well required resource protection is achieved. Compliance with Forest Practices Act rules for spotted owls is not in lieu of compliance with any federal requirements related to the federal Endangered Species Act. Federal law prohibits a person from taking northern spotted owls. Taking under the federal law may include significant alteration of owl habitat on any class of land ownership. ODF encourages landowners to consult with the USFWS with regards to compliance with the federal ESA.

    After reviewing your written plan for operating near fish-bearing and domestic-use streams, I offer you the following comments: Fully implementing your written plan is likely to achieve the resource protection standards. This operation will be evaluated on the basis of how well required practices are applied and how well required resource protection is achieved. I have some additional comments and recommendations as follows: Ensure a 60-foot no-direct-spray buffer is left on aerial application units adjacent to fish-bearing and domestic-use streams.
